He is saying state officials have the authority to enforce this part of the Constitution. Theoretically, if he is right, a Secretary of State in a state like Georgia could just leave Trump off the ballot. (do personal insults matter I have been asked? )

Even you are not dumb enough to believe that someone can be determined to have committed "insurrection" without even being charged, much less convicted, of insurrection.

Everything in that article is law professors jerking each other off in fantasyland.

There were no court rulings that determined the men of the Confederate Army were part of an insurrection but they were certainly treated as insurrectionist and this part of the Constitution was created for that purpose.

I sat home that day and didn't say shite about it. Does this mean I was also involved in the isurrection?

Yeah, it's a riddle, wrapped in a mystery, inside and enigma, how there are so many anti Trump articles from the democrat propaganda media, and generationally democrat controlled academia with their marxist/communist journalism schools. Just can't figure that one out.

The clause was created to deal with the insurrection of the Civil War and still exists today.

What these lawyers are saying is one can be barred from holding office if some official decides that person was part of insurrection.

Raffensperger, for example, could simply say based on his experiences with Trump surrounding the 2020 election he has deemed him unworthy under this clause of appearing on the Georgia 2024 ballot.
