I can’t locate where I read this. This appears to be the very weak legal ground they are using.

“Under the Administrative Procedure Act, an agency has to show that its actions and policies are not ‘arbitrary or capricious. Courts also require agencies to show that they have considered the interests of any parties who may be relying on that program.

DACA could affect more than a million people directly, and many more in their families, businesses and colleges where they contribute to their communities. There is no evidence that the administration considered those interests in any way.”


It’s just all bullshite and overreaching by the court.

Revoking/rescinding an EO is not "enacting" anything.

There's a real question as to whether the ACA should even apply.

SCOTUS needs to rule that the President has free and unconditional supremacy over revoking executive orders regardless of the President's reasons or lack thereof and Congress and the Courts cannot stop it.

Would go a long way putting these activist judges in their proper place.

I would send that judge a letter. You do not have jurisdiction here. The Constitution gives the Executive Branch certain Powers and the Judiciary the same.It does not grant one branch superiority over another. You have overstepped your authority this does not fall under your jurisdiction and I do not recognize your order as valid or legal.

Let them howl about that. It is long past time someone ended judicial tyranny and put it to the test.

Is there a law that says EOs must have a sound reasoning to be legal?

It seems like we're now (and not during Obama's reign) in a situation where for any EO the executive branch makes, must be approved by the judiciary as sound reasoning. That doesn't sound constitutional.

It isn't and no judge has veto power over what the Executive Branch does. Trump should send the judge a letter saying his order is illegal and not valid.

I know the military is disciplined....I just can't figure out why whites and Louisianians won't pull their fair share.

43% of new recruits in the military are minorities, also a ton of green card holders from "GASP" Africa and other countries. Great Americans looking to better their lives and serve their new country.

What? You didn't read that graphic correctly. Nineteen states are underrepresented including CA, NY, MI, NJ, PA, as well as D.C. What's your point? The story really doesn't prove much.
