Still the Commander's discretion on whether or not to bring charges.

I can imagine the REEEE media conversation with that commander going something like this:

Reporter: How dare you not prosecute?! I will organize a protest in front of your office.

Commander: That's going to be pretty hard to do when you aren't cleared to enter the base. (Sends email to the Provost Marshall directing the individual be placed on the restricted list)

Reporter: You can't do that! This base is public land!

Commander: I just did.

Love you angelle, but I must express a slight “Point of Order,” however: 99% of the United States Military would NEVER openly support a surrenderist, appeasing, retreating, Muslim sucking piece of shite like jug eared Hussein. They love and respect the REAL leadership that this Commander in Chief gives them.

Point of Order #2 - Bringing up charges against anyone in the military is at the discretion of Commanders. A higher level commander can override the decision of a lower level commander only to increase the severity of the charges, not to remove them.

Example: A Battalion Commander cannot overrule a Company Commander's decision to put a Soldier on NJP related to a Company Grade Article 15 (Reduction of one rank in the case of E5 and below, 15-30 days reduction in pay, etc or suspended sentence of the aforementioned) to remove the punishment altogether or else he/she is guilty of "undue Command influence"

Yeah, but in your example, what percentage of the time would you guess that a Company/Battery/Troop level Commander would stick to his or her original recommendation rather than “voluntarily” have a “change of heart” and go easier if a Battalion Commander expressed displeasure with the severity of the punishment? I’ve seen it happen. Not often, but it happens. Gotta protect that 1 Block Command OER.

Unless you were me and didn't give two fricks about my top block. Told my BC I was sticking to my ruling.

Still got my top block from the BDE CDR.
