So he is going with the Hilldog defense, intent.
In the case of documents not marked as "classified", it would form basis for a defense. HRC's situation was different.

ey for leaking Its all a show. Trump is not playing the long game he doesnt have the people in place or the gumption to follow through. You dont let Comey off for something like this because you might get him for something else later. Thats the opposite of what the DOJ does. They think you do crime A but can only prove crime B so they threaten the max punishment for Crime B. Happens all the time in violent crimes they cant prove so they process them on drug charges.

You scored the big BINGO! Prosecutors pile on everything they can to increase the appearance of criminal activity and guilt. The more charges/indictments the more likely you'll get some rat bastards incarcerated.

this was hopeful. LINK

Bottom Line: We are soon going to see an IG report exclusively on James Comey.
As rumors of action against Strzok based on IG findings are also swirling, I'm not sure the IG critique at this stage will be confined to Comey. But it will carve out FISA related findings which, assuming Comey was involved (as he almost certainly was), were always the bigger legal threat.

Comey is guilty of much more serious shite than leaking stuff to the press.

You don't charge someone for jaywalking when they're guilty of robbery.
This is my hope as well.

That said, they could have just said, “We’re not prosecuting at this time because we have other investigations involving this individual ongoing.”, and then simply added this charge to the others later.

But they didn’t do that. They actually appear to have made an excuse for him (no intent), and are saying this is why they aren’t charging him.

It’s fricking bullshite. There is no “no intent” defense in the law if you do something illegal.

And on top of that, how in the blue frick can you steal classified work materials, leak them to a friend with no security clearance, and then ADMIT you did this for the purpose of him leaking them to the press in the hopes of triggering a special counsel, and somehow he considered as not having “intent” to break the law???

This is absolute goddamn fricking bullshite.

That's ^^^^ an important question. If the Swamp gets away with the corruption we've witnessed over the past 3 years I'm afraid a lot of conservatives are going to the political sidelines, why not, we now know how powerful the D.C. Swamp really is. I also started a thread last night that presented that scenario as one sneaky strategy to end Trump's presidency in 2020, let all the criminals walk and completely demoralize the conservative patriots and hope they don't turn out for the 2020 election

Tashina Gauhar still has a job at DOJ. Thats all you need to know right there. Swamp gonna swamp you guys.

Except there is a political angle here. Maybe you're right. Maybe Barr is going to play softball. I'm not not jumping that shark yet though.

“Everyone at the DOJ involved in the decision said it wasn’t a close call,” one official said. “They all thought this could not be prosecuted.”

I knew it. Deep down, i held out hope that justice would be served, but knew this would happen. I’ve lost hope in the DOJ as it apparently infested with political hacks that all have dirt on each other. Good thing is, if people keep getting zero punishment for breaking the law, it allows others to do the same. Let’s all quit paying taxes. They can’t put us all in jail, and need taxpayers to fund their corruption.

If they don’t bust the jaywalking robber for jaywalking (which has a lower bar to meet), they’re not likely to charge him with robbery, either.

I’m not saying it CAN’T happen. But this is not a good look.
