why? they could write a backdated promissory note on the back of a cocktail napkin right now and walk away from all this?
eta. show me the promissory note and evidence of the loan proceeds being paid from Joe to Jim. Show me the tax return from both of them showing the loan. If you cant do that, toss them both in jail.

Where's the influence? You have to prove influence.
A ""loan"" with no terms is a gift.
It would need to be documented on a 709.
Willfully evading gift tax obligations or filing a false return at that level would qualify as tax evasion w/ fines up to $100,000 and 5 years in prison. We could probably start there. Of course we're assuming the transfer was ever made at all. That should be pretty easy for Potatobrain to document though.

They’d better have a way to show interest payments or tax payments.
Or at least that’s what you’d have to show if you, a normal citizen, borrowed so much as $17,000.01 from a relative.
Assuming you aren’t worth $1b+ or hold public office as a registered Democrat.

Like someone said, loan repayments aren't typically considered taxable income.

Personal loans are generally not taxable income. IF this was legit, what would show in the taxes?
I don’t think it’s legit. I’m just saying that Joes taxes aren’t dispositive.

an interest bearing loan of that size would almost certainly have tax implications, especially if it was for an investment. It not being reported could be an attempt to evade taxes even if the loan was legit (its not).

Bank statements would not support a faked promissory note. They would need to produce statements showing the transfers and that those transfers align with the note.

Interest on the loan is taxable. If Joe didn’t report interest income it would be a gift. If there is no 709 then they have an issue.
Of course we all know there wasn’t a gift or a loan. This was a payment for influence.
