The AAMC brief refers to four studies in support of this claim.

All four document Black patients’ problems with pain management, but crucially, not one examines the efficacy of doctors of different races. The AAMC either failed to read the research or deliberately created this claim out of whole cloth.

The fact that—I don't remember the exact wording now—she essentially said that she didn't know what natural rights were (or didn't believe in them) during senate confirmation hearings should have been an automatic disqualification from the seat.

This is no surprise to anyone who watched her train wreck of an approval process in the Senate. Dumb as a box of rocks. So, now we have her and the "wise Latina" dragging the Supreme Court into the gutter. A heavy weight.

Dred or Plessy requires her to be writing a majority opinion. I don’t see that happening outside a 9-0 anytime soon.

There is an outside chance of one but I see a lot more 7-2 majorities with Brown and Sotomayor on the outside looking in.
Kagan’s a lefty but she knows the law well enough not to make a completely stupid unsupportable decision. She’ll at least find a way to make it sound logical.

This is basically telling us that the majority of her opinions will be based on feelings, and she will contort laws and precedent to support her approval or dissent. Even if it is factually false.
I can understand some bias as long as the rule of law can support it, but to twist it to meet your social views is a disaster.

She isn't an Originalist or a Textualist, so she will often see things differently than the current SCOTUS majority. On a different court, should would probably be the one writing the important majority decisions. As is, she writes a large percentage of the coherent dissents.

AFFIRMATIVE ACTION hires make all minority candidates look bad. I am sure there are competent minority lawyers, but the competent ones (Thomas, Marshall) are not woke enough.

She's not there to be any of this, she's there to UP HOLD the constitution.
