As someone has already pointed out to you, this is not how DUI/DWI works. I don't know about the mandatory 8 hours, but it is definitely tied to your BAC level. You have to stay in the "drunk tank" long enough to no longer be legally drunk.
ETA: At less than 4 hours, he was either barely drunk or not at all. Might have taken him that long to get processed and get ahold of someone to come get him.

Unless you weigh 100 pounds this is false. Approximately 5 light beers at 200 pounds within an hour would put you at or around 0.08. 1 beer an hour after that would keep you there.
