You left out a very important piece.
Booked at 12:30 and released around 4am, so he was released within 3.5 hours. Given how slow jails are to process these things, wouldn't this mean he was just barely over the legal limit?

I don't really care what anyone thinks about Alex Jones, he's an idiot, but .08 BAC for DWI/DUI is stupid and I'll defend anyone who gets booked near that low level. No one is drunk at .08 BAC.
