How are police supposed to differentiate someone having an abortion from someone having a miscarriage without an investigation?

They aren't, without an investigation, but that's true for pretty much every illegal activity.

States have laws against murder today, and not every instance of murder is even known, much less able to be proven to be murder. The laws against it are still good both for general prevention (most people still know that murder will likely result in jail or worse) as well as providing the means for justice when the act can be proven.

Outlawing abortion doesn't mean every abortion will be prevented or even be able to be prosecuted, but it will both lower the overall number of abortions due to fear of just prosecution as well as provide a means for judicial recourse if probable cause can be obtained and violation of the law proven.

Totally agreed but the optics here are awful for two reasons. Does anyone really have the stomach to start investigating a grieving mother who had a miscarriage? Then the judicial system being what it is, is it a wise choice to then put on trial that person when local yokels think they can get a conviction? These election year stories write themselves.

Are you under the impression this is difficult to determine?

You have far more faith in govt workers than I do, apparently. There's far more to lose than gain here I think.

Ending an ectopic pregnancy is now murder of a minor in Alabama.

That's life threatening and is the an exception to Alabamas abortion law.

I'm only discussing what should be done, not what will be done.

IMO, all such investigations should be done in a sensitive manner, but optics shouldn't dictate justice.

This is going to come back to haunt conservatives, as “life begins at conception” will seem ridiculous to millions of reasonable people due to this ruling. It’s a Pyrrhic victory for religious nuts.

It's a well established and long-standing biological fact. Why do hate science?

Now if you are in a car accident or bump a pregnant lady that has a miscarriage you can be tried for manslaughter. If you can show product causes damage to fetus it’s a criminal and punitive damage case.

It's always been that way jackass. Which never made any sense when abortion was legal. How the frick could you charge a person with double murder for killing a pregnant mom but she could legally kill it herself

Your daughter wouldn't want to be able to hold the facility accountable if they left a door open negligently and a patient destroyed her embryos? Because that's what happened here.

Negligence is one thing and the emotional pain and suffering can be determined by a jury

Raising the specter that a potential criminal charge could follow is something else entirely
