The government must prevail in every suit to keep its policy in force, but plaintiffs can block a federal statute or regulation nationwide with just a single lower-court victory.

Universal injunctions exceed the power of federal courts, which can only provide a remedy for the injuries suffered by the specific plaintiffs in the case.
They also create other legal and practical problems like encouraging forum shopping and allowing one district court to effectively cut off other litigation on the same issue

If tweet fails to load, click here. Millet seems to dismiss that 5 people properly filed and were removed from the planes manifest.
It has been said, that some declared all of their tattoos of gang insignia were not conducive of them being gang members.

Fox News just commenting this is fast tracked to SCOTUS and rumors that Kagan is the one to receive it.
Then there is this.

MSM talking points of the day.
ALLEGED gang members. Dismissing that ICE knows their job...
And of course CONSTITUTIONAL CRISIS
A crisis because of judicial activism, Boasberg is a known Trump hating hack, and a dumb as a box of hammers Obama Judge

You're forgetting the Due Process of the 5th Amendment
quote:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
quote:
We reject this argument. Whatever his status under the immigration laws, an alien is surely a "person" in any ordinary sense of that term. Aliens, even aliens whose presence in this country is unlawful, have long been recognized as "persons" guaranteed due process of law by the Fifth and Fourteenth Amendments.

I'm just commenting on the clearly established law that illegals have certain constitutional rights, specifically due process.
There's a meme in the MAGA echo chamber (spilling onto here routinely) that they have no rights, and I was specifically responding to someone (incorrectly) interpreting the 14A, pointing out that even with the faulty interpretation, it's somewhat irrelevant (given the 5A applies here to a federal matter).

the biker shootout in Waco Texas is a good case to compare against. The fbi and locals instigated a conflict where 9 of 11 fatalities were caused by police. 220 bikers rounded up and held in jail without bond for 12-24 months without a hearing. The feds pronounced all guilty without a trial, and the bikers were American citizens.
What? Where did you get this shite?
No federal charges were filed and no one was determined to be guilty.

I am not good at interpreting long sentences with a gazillion clauses. Honest question, how does, or could, 'public danger' apply here?

I believe that's applicable to the "or in the militia" qualifier.
But I agree, they could have written this more clearly.

This just proves the left is hell bent on not letting Trump get any wins. Everything will be fought to the nth degree.
If the left cared more about American citizens as much as they say they do, then this country would be so much better. I don't give a damn about the rights of illegals who come to this country and do evil like Tren de Aragua members have. They shouldn't have any.
