The video doesn’t look great for anyone.
The driver could clearly see it’s a police officer (assuming he’s in uniform). He processes it and decides the best action is to drive off.
The police officer shoots a guy who is not putting him in any imminent danger.

You might be surprised. If you're not being detained under reasonable suspicion (as opposed to a fishing expedition or cop wanting to play bully), the cop has no authority to pursue you.

It bothers me that the cop is parked like he's going in for a Big Mac, the vehicle not in any position consistent with action relative to this kid's car, and the cop car's lights are not flashing.

A cop is unable to recognize a car the next night that fled? All I'm saying is answer the question. Is this the same guy, yay or nay? Given the current political environment it is reasonable to assume they aren't pursuing the charges for political reasons. Alternatively, maybe they are holding those charges as leverage against the impending lawsuit. We don't know because no one is reporting on it and that in itself is suspicious.
