pipeline project temporarily halted

Construction of a segment of the Bayou Bridge Pipeline project near St. Martinville was temporarily halted because tree removal and other construction was done on the landowner's property before the expropriation order. Their arrogance knows no limits. The taking of the private property for "public purpose" is expected to happen at the end of November.
It should be interesting to learn the fate of some of the "trespassers" because they were given permission to be on the proposed route by the landowners. Some of the protesters were arrested by off duty state law enforcement officers that were moonlighting for the pipeline company.

I hope those paid protestors rot in St Martinville Parish prison. Same idiots that caused 100% more environmental damage in North Dakota than what the pipeline did.....same is happening in the Basin.

I agree that those that cause environmental damage should be jailed. You tresspass, you go to jail. The law was passed so that there would not be demonstratons that South Dakota endured. Environmental groups would argue that strict trespassing laws are being passed to keep the public from seeing what is going on. Go figure.
As I appreciate it the protesters in St. Martin Parish had been granted access by the property owners. They were arrested prior to expropriation of the easement by Entergy Transfer Partners. Therefore no trespass.
Here's the rub. Eninent domain allows for the landowner to not have a chance of stopping a petroleum line from crossing his property. The little guy loses again.
It is my opinion that many Louisiana politicians get their marching orders from Big Oil and Big Business. If they do not cooperate they don't get campain financing and perks(duck and deer hunts, LSU and Saints game tickets, golf), and a whole laundry list of payoffs. Do you agree?

Yes but that has little to do with this discussion other than the fact that it probably made it easier to get the protestor legislation pass. The bottom line is the protestors are putting their own lives in danger, costing the state money, and are simply wrong in what they are saying 99% of the time especially about this project.

So what you are not saying here is that exorbitant amounts of money were offered for land that was basically good for little other than hunting prior to eminent domain being used which is valid under the law.

Just the opposite. I have no idea how much was offered land owners in St.Martin Parish. However, I suspect that it will be a first for a pipeline company to offer a landowner an exorbitant amount of money for his property used for hunting or even any designated us.

I can tell you that Entergy Transfer Partners paid landowers a pittance for the lifetime rights-of-ways obtained for the Bayou Bridge Pipeline spread along Gauthier Road south of Lake Charles. The zoning in this area was agriculture and agriculture/residential.
Eminent Domain granted by a 5-4 Supreme Court decision is indeed legal. Under its broad interpretation private-for-profit pipeline companies have taken private property which had not benefitted anyone but its shareholders.
Closer to home I can refer you to the Louisiana case of Exxon v. Hill. This case is about methods of appraisal for the area expropriated.
Another good read is Matt Randazzo's legal brief. He is a Lafayette attorney that represents oil and gas interests but an honorable guy. It spells out what pipeline companies must do prior to expropriation. My family had a case dismissed because the pipeline company failed to meet all of these requirements prior to filing the law suit.
I have a law firm on standby that can challange the Exxon v. Hill ruling because although there are similiarities there are several differences that the judicial decision was based. I hope to have the opportunity to help make new law.

So I will admit that that the amount in the Basin was probably influenced by the potential for protesting. I mean where were the paid protestors along Gauthier Road in Lake Charles??? Seems like they don't care about them. Shocking I know.

Wasn’t much of the pipeline on gauthier road part of an existing row? Other than the subdivisions, all of he vacant land was either airport or Sweetlake Land and Oil. Are you Buddy Leach???

It will benefit tax payers with a supply chain to refineries and chemical companies putting tax payers to work providing sales tax payers revenue. Maybe they didn't give you what you think your land is worth, but they probably offered what it appraised for.

Wait....so this is the first pipeline to go through an untouched wilderness in South LA? I could've sworn I've seen a pipeline somewhere else. Maybe not

Don't worry boys....this little issue that has stopped construction on a small tract of land will not effect the completion date of this spread. Basically as soon as they get the paperwork they need done all they have to do is two tie ins (yes that means that basically all the pipe was already strung and welded before this issue arose....now I wonder why that is????). Work continues on all sites not located on that particular piece of land.
