I am sure it has been discussed on here before, but I used the search function and nothing came up.

Anyways looking at purchasing a pistol for a friend as a gift and wonder what if any paperwork legally needs to be done to transfer ownership in Louisiana. Thanks for the input.

I searched ATF website and it was of no help.

No history of legal trouble and everything else is good.

Go to local police station. Request a Firearm Ownership Transfer form.

ATF Form 4473.

quote:

Question 11.a. Actual Transferee/Buyer: For purposes of this form, you are the actual transferee/buyer if you are purchasing the firearm for yourself or otherwise acquiring the firearm for yourself (e.g., redeeming the firearm from pawn/retrieving it from consignment, firearm raffle winner). You are also the actual transferee/buyer if you are legitimately purchasing the firearm as a gift for a third party. ACTUAL TRANSFEREE/BUYER EXAMPLES: Mr. Smith asks Mr. Jones to purchase a firearm for Mr. Smith. Mr. Smith gives Mr. Jones the money for the firearm. Mr. Jones is NOT THE ACTUAL TRANS- FEREE/BUYER of the firearm and must answer “NO” to question 11.a. The licensee may not transfer the firearm to Mr. Jones. However, if Mr. Brown goes to buy a firearm with his own money to give to Mr. Black as a present, Mr. Brown is the actual transferee/buyer of the firearm and should answer “YES” to question 11.a. However, you may not transfer a firearm to any person you know or have reasonable cause to believe is prohibited under 18 U.S.C. § 922(g), (n), or (x).

Outside of this, person to person sales are legal in Louisiana (with some prohibitions, i.e. felony). Best to draw up a bill of sale, many are available online in PDF.

When you do a background check for a gun it isn't for ownership of the weapon. It's to see if you can purchase it. The gun store will be the only place on record with the gun info and serial number. Unless the ATF comes looking for it b/c it was used in something inappropriate.
Then all they will do is contact you and see where it's at.
The more paperwork there is the more they know what you have. If you want to give him a gun. shite give him a gun.
Or if you are worried. Give him a gift certificate of some sort to buy it. B/c if you buy it you have to do the check.

I am not so worried about myself as I am if he was to get pulled over or need to present it to a game warden and him being in position of a gun he didn't buy. Just wanted to make sure it wouldn't cause any headaches down the road for him.

I have a friend who works for a distributer so I would be getting wholesale. So a gift certificate would't work.

They do not give serial numbers when doing the check. It's either long gun or hand gun.

If this is your worry, then have none.

Firstly, there is no way for them to tell who bought the firearm if they walk up on him

Secondly, it is none of their motherfricking business who bought the firearm

Thirdly, what you would have done in your scenario is completely legal and appropriate

If he's a close enough friend to buy a gun for I would think you would not have anything to worry about.

I bought a good friend a pistol as a college graduation present. I just bought the gun and put a bow on it.
