A few thoughts...

First I'd call the guide and talk it over, however I would be civil about tit. You say you know there was a death in the family. Well before I raised hell about it I'd would consider that perhaps a family member asked to go fishing to help heal wounds from the loss of a loved one. A video camera may rule this out but it's a possibility. Could be the guide was trying to help the healing process. Either way you should get your money back.

Pretty sure 4lsu2 is planning on calling and discussing it with him. He means him no ill will and just wants his money back. Since the guy cancelled and lied about it and THEN cashed the deposit check.

No not that I know of, fished with the guy 1 times and caught a 8lb. trout that I got mounted, seemed like a awesome guy, just hate to hear this if it was him....

You should have called his cell and if he answerd let him know you're waving to him.

I would have asked your guide to motor over there so you can introduce yourself.

At this point, I'd just call him and let him know that you saw him on the water. Also let him know that you don't want to fish with him because you don't trust him. Kindly request he return your deposit.

If he refuses, then you have nothing to lose by outing him on every outdoor message board you care to. Try honesty and the high road - if that fails then the gloves are off.

I fell asleep for several hours after starting this thread. Thanks for all of the comments and thoughts. I will keep everyone posted in the next day or so with any updates.

If you don't need the money then:

Call and tell him you want a refund since you already took a trip.
If he refuses you shouldn't have any trouble hiring a lawyer and getting your money back.
Sometimes its about principle.

Reschedule and let me know when and where to show up. After a long day of me tearing his arse up for being a count he will want to do one of a few things. Any option he comes up with will benefit the OP. Even if the guide throws a hissy fit it will be priceless after we upload it to youtube.

There's no other option than to get your deposit back and out that mf. He cancelled, he returns money. The fact that he lied is worse. He caused you inconvenience over a lie, he should be outed.
