Sorry, I misunderstood. You guys are complaining because private property owners won't hand over their property rights to the public for no other reason than it seems unfair.

Of course it is.
The main issue is those that feel the water/land was incorrectly made public by what was inaccurate mapping/laws from over 150 years ago.
Now, in saying that, the damage was done with the law and people wanting the water to be public do need to understand there needs to be some give to the landowners. We cant just go all south africa and rip the land from them.

You really should read up on just how little they had when they claimed some of these waters "unnavigable" in 1812. Basically, if it wasnt used for trade passage or commercial vessels they just called it "wasteland" and went on with their day. They didnt meticulously go through it because there was no foresight to what would happen. Also, it is pretty damn time consuming when you actually have to search it all out manually
