You won't be fighting anything but your own personal time. Trust me.

The best thing you can do is just keep an eye on your other accounts if you are that concerned.

Depends on your state's statutes. In AL the degree of theft is generally based on the value of what is stolen. The exceptions are specific items listed in the statutes. For example stealing a debit/credit card is automatically a felony. This applies to firearms, prescription meds, vehicles etc.

Call the card issuer and forget about it. It's actually their problem and not yours anyway.

Unfortunately I wouldn't worry about it. Someone used my card a while back in NOLA and racked up $700 at a Dollar General. I called the NOLA police department and they gave me the run around for 2 weeks. They finally told me that they couldn't help me b/c the purchases didn't happen while I was there in the city and that I'd have to report it to local authorities. I called local police and they didn't want anything to do with it either.

I'm not concerned, I probably just left it at the gas station yesterday and some a-hole picked it up and went to town. That annoys me.

100% yes. Unfortunately we have dealt with credit card theft recently and now there are 4 cases of identity theft out there for my husband and i!

If they sign a credit card receipt, that is exactly what it is by definition.


No it's not, by any definition. They did not steal any identifying information, only a payment method.

They can't apply for a new credit card in his name just because they have it.

These are actually easier cases to work now due to the offenders being caught on camera either taking the cards or using the cards. Easy to narrow down the time because the card companies give us the exact time and place they are used. It's all good Ed.

if it's local you can go to the gas station and pull video from the surveillance cameras and maybe get a plate #

I've been lucky enough to have my credit card company catch fraudulent charges and cancel my card for me. Except for when I forgot to tell them I was going to Vegas

Stupid DA's office needs to stop using this definition then I guess.


13A-8-192
Section 13A-8-192 Identity theft. (a) A person commits the crime of identity
theft if, without the authorization, consent, or permission of the victim, and with
the intent to defraud for his or her own benefit or the benefit of a third person, he or she
does any of the following: (1)
(2) Obtains goods or services through the use of identifying information

A signature is a form of identifying information.

I can sign an x as a signature for a credit card transaction, so your point is ridiculous. A credit card is not a source of identification, it's a substitute for cash.

If you work where claim to work, you know damned well that no one will investigate this petty case.

There were 4 transactions. I have the times and the name and store number of each place, but no address.

The address is easy to get with the store number. Hopefully the does have good cameras. Preferably in the parking lot.
