Wisconsin high court tosses out governor’s stay-home order

MADISON, Wis. (AP) — The Wisconsin Supreme Court struck down Gov. Tony Evers’ coronavirus stay-at-home order Wednesday, ruling that his administration overstepped its authority when it extended the mandate for another month without consulting legislators.
The 4-3 ruling essentially reopens the state, lifting caps on the size of gatherings, allowing people to travel as they please and allowing shuttered businesses to reopen, including bars and restaurants. The Tavern League of Wisconsin swiftly posted the news on its website, telling members, “You can OPEN IMMEDIATELY!”
The decision let stand language that had closed schools, however, and local governments can still impose their own health restrictions. In Dane County, home to the capital of Madison, officials quickly imposed a mandate incorporating most of the statewide order.

God, journalists are terrible.
The first line of the damn decision says that it is not about the governors stay-at-home order.
The Court rightfully enjoined an order made by an unelected official from the Wisconsin Dept. of Health that created criminal penalties for failure to comply with stay at home initiatives. (1) she did not follow the correct legal process for making the order and (2) she exceeded her authority with some of the provisions.

Sticking it to Trump, who is letting these shutdowns continue.

If serious, very stupid and uneducated about how this Constitutional Republic works.
They are not sticking it to YOUR President Trump, they are supporting YOUR President Trump.

Trump has been waffling on the reopening like he did with Georgia. He needs to get out there and demand everybody open now. Muzzle Fauci. Lay out how the government has breached our civil liberties and that it must be stopped. No phased plans. Etc.
Instead he comes out strong about reopening but then goes "well maybe not everybody, we’ll see, we’ll just need to see" to give him room to do what he did to Kemp.

But what about the federal money? They can’t do it because of the money.
I wish this would happen here.

I get that perception. But surely you realize the President cannot just demand that all states open up like an emperor or a king? He is trying to open up as best as possible within the confines of the rule of law. It is certain states, with certain governors, with certain party affiliations that are resisting opening up.

“Today, Republican legislators convinced four members of the state Supreme Court to throw the state into chaos,” Evers said. “They have provided no plan. There’s no question among anybody that people are going to get sick. Republicans own that chaos.”

Rebecca Dallet, one of the court’s liberal justices, dissented, saying the decision will “undoubtedly go down as one of the most blatant examples of judicial activism in this court’s history. And it will be Wisconsinites who pay the price.”
Toeing that doom and gloom Democratic party line so hard

He definitely can’t just open them up, you’re right (even though he said he could). But what he sure as hell can do is instead of attacking murder joe and bs'ing on twitter start firing off stats about how the average age of death is 79, that 30-40% of deaths are in nursing homes etc. He can get out there and absolutely start advocating for a full and immediate reopening. He can talk nonstop about how if we don’t reopen the economy now countless people will die instead of talking about football. He can stand behind the governors like Kemp that reopen instead of waffling on them. He can muzzle Fauci and say he respects his guidance and is certainly listening to him but he has to worry about the economy and lives being ruined beyond just what Covid does when making policy. He can shred his phased guidance plan and just tell the governors the guidance is to do it immediately. He can see if the DOJ can look into cases where people’s constitutional rights were trampled on and have them pursue those to the fullest extent.
So yeah you’re right he can’t just force them to reopen, but stop giving him passes on this theres a shite ton more he can do to help push a reopening.

Good, tired of the governors trying to virtue signal and one up each other. Trump should force all governors who continue the shut down to resign and if they don’t remove them by force.

Dane county is a shitstain on the state. An island of progressive filth that the rest of the state loathes.

I feel frustrated as well, Gnome, I really do. But given the circumstances and the constant pummeling and absolute lies and attacks the man has had to deal with on a daily basis, I can only assert that I remain in steadfast support of him and his ability to lead us out of this eventually. Unlike some past Presidents, he did NOT create this. I also assert that there is NOBODY better to get us out of this than him right now. He will do it.
I understand and share a lot of your frustrations. I also feel that there is nobody right now that is better suited to make things better. Certainly nobody on the left.

The fact that our civil liberties can be stripped in an instant in the name of the public safety is scarier
Reads like the prologue of a dystopian novel
