Don’t know about LA, but I’ve been told—in AL—that a cop cannot stop you for a tint violation if they cannot check it with the equipment they have. This was told to me by a SGT in a local (big city) police force.

The cop might be able to claim he saw the the tint in plain view before the driver rolled the window down.

Allowing the officer to search the window using Plain View Doctrine.

This is a fine example of the absolutely asinine ways La extorts money from its residents. The cops are going to do whatever the frick they want because it’s a third world shite hole with backwards arse rules like this to try and bring money in for the politicians to steal because god forbid they do anything to create an actual economy. I’m so glad I left that shite hole.

I got pulled over in Port Vincent for window tint years ago. I rolled my windows down as soon as I saw the lights.

He told me to roll them up. He checked the tint level with a meter, then gave me a ticket.

I went to court and plead not guilty, was heard by a judge and won. I argued (with documents) that I had just had a new inspection sticker the previous day (I rolled the windows down at the local inspection sticker place) and I was unaware of anything on the glass. It was a used car that I had just purchased.

That was my argument and I won.

In La you’ll get busted sooner or later, the brake tag or inspection sticker stations won’t give you a inspection sticker with dark tint.
Mine was legal, but the lady still asked for the tint information

They might not make you roll your window up on the side of the road and i don’t think they could legally roll up your windows. But if you refuse to roll them up, they could likely impound the car and then get a search warrant to allow them to roll your window up. Then you’d get the ticket along with some additional tickets. .

The metallic shite that keeps the heat out is worth it

Cops aren’t pulling you over for tint. But 5% makes it hard as shite to make turns at intersections at night. I have fricked up front suspensions turning left and hitting curbs without rolling the window down so I could see out

Oh but they will. The super dark tint observed in many vehicles is unquestionably obvious to the eye of most patrol officers. Just a tint violation itself? No big deal whatsoever. However if they use that as a pretext to an after hours stop, say perhaps a little too much to drink.....that's fair game for them. Same with a few other seemingly innocent violations that can lead to much worse, license plate light out for instance.

One of the things that’s surprised me the most about becoming an adult was how the amount of other adults are are pure dipshits. Like how do you function in life? The type of shite that people put up with from the general public is astounding. Not teenagers or kids. Grown arse adults.

5th Circuit heard this argument and rejected it. 736 Fed. Appx. 768.

I don't think this is correct. An ex brother in law of mine was drunk and went to a Wendy's and placed an order at the drive thru but passed out before he got to the window. When the cops got there they told him to get out of the car and he responded "Get me the frick out".

Well, they did and he was a bit bruised up afterwards. They didn't have no warrant

If he saw the tint and that was his reason for stopping you, he doesn't need a warrant under the automobile exception. It's no different than you being stopped for a traffic violation, getting out the car and closing the door before he walks up, and reeking of weed. He can then search the areas of the vehicle where that contraband could be contained.

If he saw the tint and arrived at rolled down windows, he couldn't make you physically roll them up, but he can remove you from the vehicle and roll them up himself.
