The problem is the guy who woke up on his sofa when he heard the argument and then shots said that there was hand checking between Smith and Hayes.

He didn't elaborate on if Hayes was only using one hand.

I could have also missed it, but I don't recall reading if he was questioned on if Hayes retreated to his vehicle before shots were fired.

basically at this point, it has been laid out that hernandez was the aggressor, took his shirt off and tried to swing at oneal. pt saw this. hernandez and his wife had alot of testimony that didnt match. pt never saw hayes stand over smith and say anything yet hernandez wife said he did. pt says he looked away while hernandez was trytrying to fight oneal and then heard a shot, looked back and saw hayes shooting smith.

witness in house saw people in mercedes being aggressors, said hayes was calmest of group. saw some hand checking. saw hernandez being instigator.

nobody saw gun in hayes hand until shooting.

off duty police came on scene after shooting and hayes said he got out with gun in hand and smith said he was getting his and he shot, what was he supposed to do?

That isn't what Kevin said, and I find that pretty hard to believe with the position of the cars, at least according to the testimony from yesterday.

He ran around the vehicles to get into it with Hayes? Or did he jump over the cars?

I'm guessing to dispose of contraband, cause he knew popo were definitely coming in masse. Maybe he wanted to hide it for future retrieval. His actions run counter to a person who has consumed a lot of alcohol and more of one who has consumed some sort of a stimulant.
