This is going to make alot of people mad
This is a complete guess, but I am thinking Smith had to have mentioned having a gun. If Hayes was there to Kill him because he is so enraged from the fender bender, why did he wait so long to do it? He had ample time to shoot Smith as they were arguing. It wasnt until Smith headed back to the vehicle that Hayes shot him
Now, I have no idea what that means in the eyes of the law. But that is just my pure guess regarding the mentioning of the gun

That doesn't matter. What matters is if Hayes pulled out his gun because Smith and Hernandez were the aggressors.

Smith hit and run
Hayes follows smith and hits him
Smith exits car and heads to Hayes Hummer, with Hernandez taking off his shirt and acting like an animal
Hayes exits car with gun
Arguing ensues
Smtih mentions gun
Heads back to car after a mention of gun
Is shot dead
That is my guess on what happened.
No clue what that means legally. Feels like manslaughter to me, but I am not an attorney
