Dooley: "They just both seemed angry. Will saying 'You hit my car.' Mr. Hayes saying 'You hit me first.' Says she never saw physical contact

Not sure how that proves beyond a reasonable doubt Hayes did not fear for his life.

I dont know how the casings found in the car prove anything regarding whether or not Hayes feared for his life.

Dooley says she saw Hayes' passenger, Kevin O'Neal, swing at her husband, Richard Hernandez, says she stepped in, pushed her husband away

Dooley said it seemed over, thought Will Smith was going to call police as he headed back toward car. "I never heard any mention of a gun."

this is funny since witnesses said there was mention of a gun from both parties.

Her husband probably spouted off regarding Smith having a gun in the car

This is going to make alot of people mad

This is a complete guess, but I am thinking Smith had to have mentioned having a gun. If Hayes was there to Kill him because he is so enraged from the fender bender, why did he wait so long to do it? He had ample time to shoot Smith as they were arguing. It wasnt until Smith headed back to the vehicle that Hayes shot him

Now, I have no idea what that means in the eyes of the law. But that is just my pure guess regarding the mentioning of the gun

They could be lying. She could be lying. She is also a witness, last time I checked.

The jury will weigh the testimony of all parties.

That doesn't matter. What matters is if Hayes pulled out his gun because Smith and Hernandez were the aggressors.

I thought Hayes exited the vehicle with the gun?

ETA: "struck him" as in punched him or with his vehicle?

Yes, I think Hayes had his gun first.

I am not waffling you dumbfrick. I have no idea what it means from a legal standpoint

Smith hit and run

Hayes follows smith and hits him

Smith exits car and heads to Hayes Hummer, with Hernandez taking off his shirt and acting like an animal

Hayes exits car with gun

Arguing ensues

Smtih mentions gun

Heads back to car after a mention of gun

Is shot dead

That is my guess on what happened.

No clue what that means legally. Feels like manslaughter to me, but I am not an attorney
