what if Smith "did" hit hayes 3 times and thats when hayes grabs his .45? then smith says he is going get his gun? then the act of reaching for it?


I guess I would be on trial for manslaughter in that scenario.

and? did the smith party know that hayes had a gun? It didnt sound like it from his wife's testimony.

Watch the ESPN interview with O'Neal that came out this afternoon. I've also heard that Fuller has a witness who was on the scene who saw Smith strike Hayes not named O'Neal. But you are correct they haven't introduced that witness yet or his testimony so I was merging both together--so in anticipation of when O'Neal does testify I think the foundation will be set by Fuller for this defensive strategy.

I believe they only teach this in 2L at Loyola so your good.

2nd Degree Murder statute in La:

There's other stuff but that's the relevant part. I mean, he unloaded like 9 rounds at close range. I'd say that's specfic intent

initial reports from the smith camp was he got out the hummer with it in hand.

hayes said he pulled it after the "physical" altercation
