what about him reaching for his gun, is that enough?
Not necessarily. Him reaching into his car or getting in his car is not enough, almost certainly.

Second-degree murder is ordinarily defined as: 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Second-degree murder may best be viewed as the middle ground between
Where are you getting this from? That's not the Louisiana statute last time I checked. I could be wrong.

hear me out before you jump to conclusions here
what if Smith "did" hit hayes 3 times and thats when hayes grabs his .45? then smith says he is going get his gun? then the act of reaching for it?
I guess I would be on trial for manslaughter in that scenario.
don't say that didn't happen because you don't know. no copping out.

The defense's argument is gonna be that he said "I have a gun" and then took action to retrieve said gun.
And think about that for a second. If you believe that, he's doing nothing more than putting himself in the same position as the guy who is currently holding a gun in his hand.

There's absolutely no evidence that I'm aware of that suggests the physically attacked him to the point where he felt he was in imminent danger of losing his life or great bodily harm.
Watch the ESPN interview with O'Neal that came out this afternoon. I've also heard that Fuller has a witness who was on the scene who saw Smith strike Hayes not named O'Neal. But you are correct they haven't introduced that witness yet or his testimony so I was merging both together--so in anticipation of when O'Neal does testify I think the foundation will be set by Fuller for this defensive strategy.
I believe they only teach this in 2L at Loyola so your good.

2nd Degree Murder statute in La:
There's other stuff but that's the relevant part. I mean, he unloaded like 9 rounds at close range. I'd say that's specfic intent

He brandished gun and came out car with it long before Will said a G word. Reasonable to think Will felt need to retrieve G for his own family's protection from dude holding a gun in confrontation w you
