I agree, it would totally move away from the point they want to get to.
It would probably backfire on them since they've already stipulated she's an expert.
They have way WAY better avenues of attack than such stupidity.

And that's how most defenses work. They know the facts will convict, so you focus the jury on some small, inane mistake made by the police, and boom, convince them of a frame up.
Yup.
Fuller is absolutely doing a lot of that. Trying to get them to focus on all of these little things but not the main things. Its good work by him and Daniels. Really good work.

Acosta under cross by John Fuller. I imagine we are about to learn Will Smith tested positive for gunshot residue.

ADA Rodrigue: Would someone in close proximity to a gun that was fired have gunshot residue on their hand? Acosta: Yes.

2 other guns recovered from the scene were tested, Acosta says.
2 other guns?

Figured that would be asked and answered in that manner.
That game is over.

The gun O'Neal pulled and the one in Smith's vehicle.

Remember I suggested this the other day? I think Fred was the one that shot me down.

It's interesting because the defense in this case has the favoritism/incompetence by the police angle, which Fuller knows how to play, and they also have a little white guy making death threats with his shirt off and yelling racial slurs. That's not gonna play well in Orleans.

I already know who the guns are. It was supposed to be sarcastic about KON's gun also being recovered.

On cross, I would bet the question Fuller will ask is, "How would someone in close proximity to a gun that was fired have gunshot residue on their hand, when they were shot in the back, with hands facing away"?

Fuller begins cross-examination of Acosta. Neither seems thrilled to speak to the other.

Fuller now on cross of ballistic expert. This shouldn't take long. Lead detective in Smith killing, Bruce Brueggeman, waits in hallway.

I think he might actually be setting up a great trap. He get's the ADA to go all in on the fact that only Hayes fired, then fuller openly admits Hayes was the only one to shoot, and brings up the question that if Smith was shot while he was returning to his vehicle, how IS the reside on his hands?
Creating some doubt that Smith might have been tangling for the gun when the shooting started. Let's see where he takes it.

Fuller asking if gunshot residue can wear off hands by the end of the day if someone is out and about.
Despite the fact there is absolutely no evidence whatsoever that any gun but the 45 was fired, and no testimony from anyone, even KON, that any gun but the 45 was fired, he valiantly marshals on with this obvious misdirection.
