Yup.

Fuller is absolutely doing a lot of that. Trying to get them to focus on all of these little things but not the main things. Its good work by him and Daniels. Really good work.

It's interesting because the defense in this case has the favoritism/incompetence by the police angle, which Fuller knows how to play, and they also have a little white guy making death threats with his shirt off and yelling racial slurs. That's not gonna play well in Orleans.

On cross, I would bet the question Fuller will ask is, "How would someone in close proximity to a gun that was fired have gunshot residue on their hand, when they were shot in the back, with hands facing away"?

I think he might actually be setting up a great trap. He get's the ADA to go all in on the fact that only Hayes fired, then fuller openly admits Hayes was the only one to shoot, and brings up the question that if Smith was shot while he was returning to his vehicle, how IS the reside on his hands?

Creating some doubt that Smith might have been tangling for the gun when the shooting started. Let's see where he takes it.

Despite the fact there is absolutely no evidence whatsoever that any gun but the 45 was fired, and no testimony from anyone, even KON, that any gun but the 45 was fired, he valiantly marshals on with this obvious misdirection.
