Florida Fish and Game said during the announcement that they found the body that over 300 attacks since 1948 were significant enough that someone called Fish and Game.
28 deaths. so.. every few years someone is attacked and dies.

Last year it was a lady in her 60's.

The big mistake I see is that the signage by the water said NO SWIMMING.

should have said,
ALLIGATORS.

no wading, no swimming.

Do not feed the alligators.

Disney reports alligators who do not show signs of fear of humans.
They are taken to a more remote swamp.

Governments generally have immunity from that type of liability. Public/Private property is a massive legal distinction.

They would lose, possibly on summary judgement. You have a near absolute duty to warn of known dangers, even to most trespassers. They obviously knew of this danger, b/c they proactively sought to reduce it. Why they didn't put up a sign is a mystery, but there is likely a paper trail leading to an answer that Disney wouldn't want made public.

Several years ago, my family and I stayed at a hotel in Daphne, Alabama. They had signs everywhere outside saying "Caution, Alligators" and "Be wary of Alligators". We were. And danged if there wasn't an alligator walking across they parking lot at one point.

I am curious as to there were no alligator warning signs if there indeed weren't any. Seems easy enough. So easy that I can't figure out why there wouldn't be any.

What happens if a big hawk swoops down and grabs a baby while at the park? Is Disney liable then?

No way it never came up in meetings. Only reason i can think of is worried about scaring guests.

Maybe legally they are covered with a no swimming sign (doesn't mean they won't settle this case)

Which could be a reason for the body being recovered. The gator drug the boy into the water and drowned him, but never ate him. In sharks, they often take one bite and realize the person isn't their food source. They are attracted to the movement or the shape, but they essentially taste that the person isn't food and move on. Another reason could be that the struggle and people scared the gator away after he had killed the child. So it essentially never had a chance to eat him.

I'm not trying to be insensitive, but it is curious to me.

Well, they want people to actually use the beach. You start putting signs up about scary animals and it drives people away. 27 years later, it bit them in the arse.

I did an argumentative paper on this in college. While I do think most attacks are investigative some are clearly predatory. When great whites attack seals they usually do with one massive bite then let the seal bleed out before consuming...in most cases with humans they are pulled out of the water by people nearby before the shark can finish their meal.

Gators do drown and submerge their prey before eating because their teeth aren't designed to cut through flesh so they want the body to decompose...i believe had they not recovered the body eventually a gator would have eaten the child.

BAM. And i think admin deleted my post in that thread from when i was stating that the alligator though it was feeding time or something to that effect.
