Depends, whats the guilty guys crime? Are we talking bank fraud or serial killer/pedophile?

Innocent in jail = 1 life ruined
Serial killer walking free = Many will be

Innocent jailed. Not close. You’re taking away someone’s right to freedom.

That’s why it’s the state’s job to prove guilt. Much better for guilty men to go free. Because they aren’t actually guilty until the state proves it.

This is the textbook definition of Blackstone’s Formula or Ratio, perhaps most significantly restated by Benjamin Franklin: "It is better 100 guilty Persons should escape than that one innocent Person should suffer.”

One of the very tenets of our society is having a fair judicial system based on the "innocent until proven guilty" premise. Based on that thought process, when an innocent man is convicted, that is a total and complete breakdown of our system. That happens all too frequently...

I appreciate everyone’s input. I too, said an innocent man going to jail would be a bigger failure of our system.

An innocent man jailed affects one life/family but a free criminal could affect many


That same line of reason leads to governments imprisoning it’s citizens who don’t fall in line with state ideology.

Innocent jailed because it is done at the behest of a system the individual has no defense against.

The free rapist can still get his arse capped in a truly free society by a citizen.

Our criminal justice system is based around the idea that an innocent man jailed is worse.
