Take the "why not both? Taco girl meme"...
change it to "Why not either?"
That's my answer.

Worse for the parties involved, the former. For society? The latter.

Depends, whats the guilty guys crime? Are we talking bank fraud or serial killer/pedophile?
Innocent in jail = 1 life ruined
Serial killer walking free = Many will be
Lesser of 2 evils baws

Innocent jailed. Not close. You’re taking away someone’s right to freedom.
That’s why it’s the state’s job to prove guilt. Much better for guilty men to go free. Because they aren’t actually guilty until the state proves it.

This is the textbook definition of Blackstone’s Formula or Ratio, perhaps most significantly restated by Benjamin Franklin: "It is better 100 guilty Persons should escape than that one innocent Person should suffer.”

Ask Damien Echols on Twitter how he feels about being falsley imprisoned.

One of the very tenets of our society is having a fair judicial system based on the "innocent until proven guilty" premise. Based on that thought process, when an innocent man is convicted, that is a total and complete breakdown of our system. That happens all too frequently...

innocent people should never lose their freedom

Which is worse, an innocent man going to jail for a crime he did not commit, or a guilty man walking free of a crime he did commit.
The US constitution says the former is worse

I appreciate everyone’s input. I too, said an innocent man going to jail would be a bigger failure of our system.

I immediately said innocent man jailed but the rebuttal was “what if the killer/rapist walks free and kills/rapes again”
An innocent man jailed affects one life/family but a free criminal could affect many
That same line of reason leads to governments imprisoning it’s citizens who don’t fall in line with state ideology.

Innocent jailed because it is done at the behest of a system the individual has no defense against.
The free rapist can still get his arse capped in a truly free society by a citizen.

innocent man jailed. his life is probably ruined. the guilty man doesn't always repeat his crimes
Posted on 5/28/18 at 7:42 pm to TheDeathValley
Our criminal justice system is based around the idea that an innocent man jailed is worse.
