What kind of bug is this?

All black, small, looks kind of like a beetle, flies, and bites.
I've never seen a bug like this thing, I can't pin point what the hell it is.

It's a lot smaller than a horse fly.

Could be a horsefly - some can be pretty dark. Depending on where you live, they are emerging right now. They can be various sizes - the longer they live and eat, the bigger they get...
