I don't know the exact rules in Baton Rouge but I know in PA It is illegal to drink inside a car or be drunk inside a car and have access to the keys. If you have the keys on you or anywhere (in your purse), you can be arrested for a DUI. You have the INTENT to drive. There are cases where people were too drunk to drive and passed out in their car (thinking that it was ok, since they were smart enough not to drive) and got a DUI.

So what if I was working on my car in my garage, had the keys in my pocket and was drinking a beer? Should I get a ticket then?

The fact that it was in the car is irrelevant. He would have gotten the ticket even if standing outside of the car. Having an open container is illegal ( silly I know).
Also y'all are confusing private/public ownership of land with property that is open to the public( such as a parking lot).
A public parking lot (regardless of ownership) is not the same as say your private driveway/garage.

It depends what he wrote the citation for, if it was a 32 violation its complete bullshite and will be thrown out if you fight it. If it was a local ordinance violation, thats a separate issue.

Yes they could. The same way they could right everyone a ticket on the interstate for going 5 miles over the speed limit. Just bc it's not usually inforced doesn't mean it's not the law.

In LA the law is an open container in public. I think the fine is $150. Open container in a vehicle is $450.

So him to be cited for the 32 violation(the state law open container in a vehicle) he has to be operating a vehicle on a public roadway.
