Just to be clear, I'm not saying this officer isn't a dickhead because he certainly acted like one. My only goal here to try to explain that the knee-jerk "WHAT HE DID WAS ILLEGAL!" reaction has very little basis in actual law.
The officer not immediately telling her what she was arrested for doesn't make the arrest illegal. Ordering an arrested person out of the car is legal. Hell even if she wasn't arrested at that point, he could easily put together PC enough to conduct a pat down.

Correct. This cat needed some time to back into justification for what he was pretty sure he could do. We can't expect cops to know what they're doing and why just like all the time. Let them arrest us and then figure out why they're arresting us is really the best policy for everyone involved.

Have you ever actually seen a PC hearing in court? It usually goes something like,
"I knew this area to be a high crime/drug use area."
"I observed the car to be breaking a traffic law."
"Upon approaching the car, I noticed the driver was nervous and fidgeting in response to my questions."
"I smelled marijuana on the air inside the car."
"Therefore I believed them to have illegal drugs."
That is PC in a few simple answers to a prosecutor's direct examination.

I was being 100% serious. Requiring a police officer to multitask has deadly potential. Let him focus on getting his cuffs on you and let his out-of-shape body adjust to the exertion it just took. Then let him collect his thoughts and back into his justification for his attempts to make up for his poor life choices. It's in everyone's best interest.

BS - The signing of the ticket is just acknowledgement that you are at the scene. Nothing more. You don't promise anything other than you were present.
The more I think about it the more I believe he could have handled it differently, but had the right to remove her from the car. He has no idea if she's psycho or going to escalate the situation further. I still think he could have handled it better, but he was within his right to ask her to exit the vehicle.

I'm reading through page 12 and I run across this. The situations you propose do not compare to what may be perceived by a cop as warranting further investigation.

Exactly why he needed to escalate the situation to evaluate her. It's hard to tell someone is unstable unless you antagonize them. Cop made the right move.

I'm rarely on the victim's side when they provoke, but the cop was a dick that didn't like being disrespected IMO. He should be in a different line of work if he can't take this attitude these days. He is the one making it worse by questioning her obvious frustration and I hope he feels some responsibility.

It's not his fault she was "frustrated", if you aren't prepared to follow lawful orders then you shouldn't be driving a vehicle. Sometimes cops have to provoke citizens to judge how dangerous they are, this was a text book case.

I get they are human, but how in the hell is this protecting and serving? She gave him her papers and he wrote the ticket, but didn't like her attitude so he wanted to show her who was boss. The end.
