You say school policy can take away a students right to have an American flag shirt, so it’s natural to ask why can’t school policy can’t dictate it elsewhere

If the school hates the American flag and think it stands for white supremacy, why are they flying it throughout the school?

Clearly they did. They revoked the student’s parking pass for having a large American flag in the bed of his truck.

That’s not what we’re dealing with here, the flag is in the parking lot. But in any event, he likely would have the right to drape himself in an American flag inside the schoolhouse doors.

Another dumb question. That would be like the school saying you can only have xyz tires on your personal vehicle. Or you can only drive xyz vehicles. They can determine what you wear and do inside the school... not with or on your personal property.

Absolutely. Stay seated everyone morning in my classroom. Encourage students to do the same. Even told my Marines not to.

Well that would ACTUALLY be a distraction and the school would have an argument here. But a flag on a car in a parking lot? Nah.

Bottomline, you’re wrong here. The school is going to get sued and will have to pay this kid for violating his constitutional rights.

Are your clothes not your personal property?
I know my daughters uniforms are bought by me. I don't think inside the buildings hold any different legal standing to outside in the parking lot.
