I'm curious as to the source of the mugging claims. I find it hard to believe there were eye witnesses who say it was a mugging while the NOPD ups the charges two weeks later to second degree murder.
I find it incredibly likely that Ward would suggest it was a mugging. Not sure what other choice he has for a defense.

I'm guessing Ward is counting on the "he's trash and I'm not, so who are you going to believe?" Routine.
And the black being homeless and living in government SUBSIDIZED housing is contradictory.

Not sure, but I took it differently. I think the mugging is the ad hoc.

, true, but they're not likely to arrest you for second degree battery if you've got witnesses saying he was being mugged and others saying it was an attack for no apparent reason. I'm skeptical they'd continue down that path two weeks later when Red eventually died. Think about the Gasser situation. I realize that wasn't NOPD, but he was interviewed and released before eventually being charged with manslaughter. That charge was then increased to second degree murder.
