It’s also possible the baby was born stillborn or she miscarried (they’re still determining cause of death and she hasn’t been charged with murder). And fetal remains laws here are complicated when it comes to an individual who has a spontaneous miscarriage at home depending on at what week it occurred.

Sounds like they are still trying to determine cause of death. I imagine any proof that the baby took a breath outside of the womb and you will see the murder charges hitting pretty quickly.

Local news said first responders found the baby "unresponsive ". I don't think this was a stillborn.

I’ll be curious if she attempted to get medical attention for it too. We’ve had women sent home mid-miscarriage here over legal confusion on what point they can treat if it’s not causing sepsis or life threatening (like preeclampsia). And I think 20 weeks is the cutoff for providers reporting and having to “manage” the remains.

The article also doesn't say how far along she was. To increase the hype they refer to it as "an infant," but don't say if it was full term or whether this involved a still birth at 10 weeks or something like that. The sensationalism may be deserved, or it may not. I guess we will see.
