COLORADO SPRINGS – A Fort Carson family wants to share their story with others after their 10-year-old son was arrested and charged with Felony Menacing, a Class 5 felony, which has since been expunged.
“They came back over, told me my rights, and told me what was going to happen. They put handcuffs on me, and I got into the car,” 10-year-old Gavin Carpenter said. The incident happened in July of 2019.

FOX21 exclusively interviewed the 10-year-old. Gavin said he and a friend were playing outside with toys near N. Powers Blvd and Constitution Ave. He said they were playing a version of the video game Fortnite.
“The toy bow was an orange Nerf bow. It didn’t work. Nothing could shoot out of it. Nothing would come out of it. The weapon, well toy I had, had an orange tip. It was also broken and couldn’t shoot anything out of it,” Gavin said.
Gavin stated they pretended to shoot at about 5 to 10 cars until one man stopped. He said he and his friend ran to his friend’s grandparents’ house.
“He slammed his breaks and started reversing as fast as he could,” Gavin said. “He came up and started getting very heated and was very mad. I was at the time, very scared.” The man called the police. According to the Carpenter family, El Paso County Sheriff’s deputies arrived and arrested both Gavin and his friend. He was handcuffed and taken to the Colorado Springs Police Department for mugshots and fingerprinting.

Damn, my nine year old was outside yesterday shooting his real 20 gauge shotgun. I guess in Colorado they would give him the death penalty.

Its not a good idea for a kid to be playing with toys guns (ones that look real), but to arrest them? That's just fricking stupid. Way to protect and serve you fricking moron police.

Yes. Any gun related playing is forbidden, including plastic guns and guns made with fingers.
Now, if your little boy wants to put on make up and a dress to dance in front of the adults that's a great alternative.

Huh? I believe the opposite. It's not the kids who are shitty, it's everyone else who is afraid of their shadow. Thanks a lot, Bin Laden

The fact you think an orange nerf bow looks like a real firearm is not surprising.

Article and News Video about situation
OP's link wasn't working. Apparently one of the kids actually received a felony charge that HELD UP in court. Family says it took them a year and thousands of dollars in attorney fees to get it expunged. Insane that the cops didn't let them off with a warning

Is this a #BacktheBlue situation or were the kids white?

That's what's criminal. Some bullshite menacing law with language in it like a black hole. Everyone can be a criminal these days.

In this day and age, it’s better to live by the “see something, say something” motto. These kids might have devilishly stuck orange tips on real weapons and were on their way to hold up a lemonade stand.
Call the police and let guys with real weapons sort it out. As long as the kids are compliant, it’ll be okay.

The fact that you missed where I said "ones that look real". I was saying that as in general.
There are toy guns that look real.. or if you take the orange tip on the barrel off.. It looks real.. But any cop that sees an orange nerf bow and it ends up in them arresting that child, they are fricking idiots and should be let go just for being so fricking stupid.

They had a broken toy nerf bow that looked something like this...
Are you saying you’d think this was real?

BS. Toys now a days have giant orange ends, there is no way for them to be mistaken for the real deal unless it is by an anti-gun leftist POS.
