One billion percent yes. Holy shite, do you actually think that's debatable there? If you, as a private citizen, shot that guy and there was no gun, you would be thrown in jail with a murder charge.
Please tell me you don't conceal carry, because literally any basic class would tell you that is a horrible idea. If at all possible, you get the frick out of there. If someone is breaking into your car and you do NOT keep a weapon in there, take a picture and call the cops. Why would you even go out there displaying a gun?

Deadly force isn't justified.
Here's something that will make you say is total bullshite... they can possess a weapon, but if they aren't necessarily pointing it at anyone, deadly force response isn't justified in most cases.

They better lock her arse up!.... being honest here even thogh we have to have them, I can't stand a cop but she lost it and shot him down without cause. She will do time over that shooting. How much,... who knows but she will and should go down for that shooting.

Agree this is the most likely scenario. Multiple cops with only one firing a shot and only a single shot at that. I think she panicked and pulled the trigger.

In the video to the side they show the window was up.
Surely some will comment about the the front window being much lighter. As with most vehicles, the backs are tinted, not the front. And his SUV is one of them

What if they are deaf, don't speak English, a diabetic confused from low blood sugar, or having a drug reaction, maybe have a mental illness, or any of a hundred other things that could cause a person to appear to disobey because at the time they don't understand what is happening? Law enforcement has devolved almost to the point of if they don't understand it they kill it.

That said, he didn't deserve to die. There was an officer right next to her with a taser. Let him light up Mr. "I'm gonna do whatever I want" and let him dance to some voltage. If he produces a weapon at that point then you double tap and call it a day. But she never let the taser have a chance of doing the job. She f-d up and now gets a chance to explain it to a jury.
Not the first time a female cop was too quick on the trigger FWIW

I believe the major determining factor in this case is whether or not the guys windows were up.
I have seen reports claiming the window was open, and i have also seen reports claiming that it was closed. I honestly dont know what to believe.

Her version of what transpired didn't correspond with evidence collected at the scene. The only thing that'll save her is if his toxicology reports show that he was on something. Otherwise she's screwed. She let her fear/emotions get the best of her.
