Lee Merritt, an attorney representing Yarber’s family, told the Guardian that Yarber was unarmed and posed no threat.

“They saw a car full of black people sitting in front of a Walmart, and they decided that was suspicious,” Merritt told the newspaper. “They just began pouring bullets … It’s irresponsible. It’s dangerous. It’s mind-boggling, the use of force.”

Merritt wrote on Facebook on Tuesday that Yarber was “profiled, stalked and murdered” by police. He also shared photos of Yarber and video from the scene, describing a version of events different from what police recounted.

One can argue if it is the best policy to shoot into a moving vehicle. Some departments have banned this practice, but overall, a vehicle is a deadly weapon that can easily seriously injure or kill someone. To claim Diante was unarmed, nonviolent, and not an immediate threat to officers is a complete falisification of the facts in order to fit a narrative. He was a threat in every sense of the word.

The evidence these morons are using to state the cops were not in danger is the words of the family's attorney, who, as you saw above, it making such rational statements as "they saw a car full of black people and just started shooting." Not to mention, they were called by someone else to the scene. This was not the result of proactive policing.

BARSTOW -*- A Barstow man who escaped authorities after being arrested Thursday was on the loose and considered to be possibly armed and dangerous, authorities said Friday.

Police arrested Diante “Butchie” Yarber at approximately 11:55 a.m. for being a felon in possession of a firearm and a parole violation, according to a news release from the BPD.

Yarber, 22, was transported to the Barstow Police Annex for an interview, then escaped as a police officer escorted him to a patrol car to be transported for booking at approximately 2:30 p.m., according to the release.

Yarber was sentenced to four years probation last year for child abuse and/or endangerment, and resisting or obstructing a peace officer, court records show. He was sentenced to 487 days in prison after he was arrested in August 2011 after he aimed a shotgun at a group of people and then fired into the sky, according to previous reports.
