Amber’s whole direct. She rambled and rambled. You don’t want your client to look rehearsed. But you’ve got a plan, and you go over it with the witness. I discerned a plan from her lawyer (mostly chronological showing escalation). Amber just was not following it.

The pictures. Amber insisted that she was beaten, stomped on, had a broken nose, etc on very specific dates. There is abundant photographic evidence showing her looking pristine on those dates. There was no explanation (inoculation) of the photos in her direct. It leads me to believe that Amber insisted on saying things that could easily be disproven. She wanted to list every single time she thought Johnny had abused her, even those that were easily refuted.

The oversell. She does have one or two photos showing actual bruising. She WAY oversold them. “Johnny beat me for an hour. Here is a photo of a scratch on my arm to prove it.” You don’t let a witness do that if you’ve got control.

The storytelling. Trials are story. You believe witnesses who tell a story that fits known facts and fits the experience of the people listening. You also play to gap fillers, that is, implied assumptions most people will draw to fill in facts. “I went to the movies and got a snack.” You’d think of popcorn most likely, although I did not say it. This is a powerful tool of persuasion. Amber kind of did the opposite. Instead of stating objective facts objectively, she went with weird details and over explanation. She was selling, not narrating, and it showed. You don’t let a witness do that if you’ve got control.
