like i said earlier, Uber is still in its infancy trying to establish a model that will realize profits. adding in all of these costs (employee status, namely) will basically destroy the ability of Uber to ever make profits

I would also argue, regardless of the fact they win the substantive argument, a ruling against Uber would be bad from a public policy perspective. This would basically end them, and the "employees" wouldn't have any benefits they want, and Uber provides an incredible service to the consuming public.

uber is a 5 year(?) startup so those numbers are staggering.

$100m loss for the quarter is huge. They won't be able to withstand the legal onslaught that is about to hit them in the United States let alone their fight internationally.

the public policy argument in places like San Fran is one against Uber, which is why the judge had to rely on such bullshite reasoning
using Unconstitutionality means a judge didn't have the law or facts and is making a political decision based off emotion. it is a completely nebulous legal term that's basically a "get out of jail card" for progressives who don't have the law or facts on their side.

i don't think so. it's a completely new business model that has kickstarted the sharing economy, creating all new avenues for the method
think about the development in technology in terms of just connecting people and services to cut out operational costs that affect the prices of those services, and realize how big of a step forward Uber was

What I'm confused about here is suing Uber in class action form will result in a minimal payout to the driver. And put them out of a job.

well 2 things
1. from the contractor POV, they have the simple-minded progressive analysis that nothing will change in the model and they will keep being able to take advantage of all the benefits of contracting with a company like Uber, while getting all the new benefits they seek. they don't think in terms of "oh this will kill Uber and eliminate the possibilities" and if that does happen they already have a spin-response ready "Uber is just being greedy and cares more about the bottom line than its employees"
2. statists supporting the status quo want to crush new technology that changes the paradigms. these groups hate ideas like Uber b/c they attack traditional industries that are regulated and "play the game" with regulators. authoritarians seek power and killing technology that threatens their power grab accomplishes this

From the article in the OP the lawyer addresses this exact issue stating...

There's probably a handful of die hard employees pushing this. The vast majority were told "hey, we are filing a law suit, if we lose, you keep your job and nothing changes. If we win, you get more money. Want to sign up? All we have to do is put your name on a list."
