Seems like you're within the range to be bit at that point, unless you're overhand axing it, but seems like it'd be easy to lose the shovel and the downward motion puts you in range, yet again if you miss

the rule is cut off the head and bury it, not cut off the head and pick it up.

I always thought this video of a decapitated snake biting itself was pretty cool. (Youtube video, 2 minutes long, bite happens at 25 seconds into the video)

It is a rattlesnake that has been decapitated over an hour and yet the body frees itself from a bucket and even strikes at the person picking it up by the tail (about the 1:10 mark).
Oh, hail, NO!!!
