Plenty of great criminal defense attorneys in Alabama, so I can just about bet it was he ignored the advice of counsel and went to trial. However, any trial time is good trial experience for the defense attorney. The defendant got his day in court, and he'll get his years in prison for such.

Should've went with:

He is good at getting the Utes off.

Don't be a criminal and you won't have any problems. I have zero sympathy.

I do not like the idea of trying a minor as an adult. One should be a minor or an adult, the state should not be able to change it as it suits them.

Not siding with this person, did not read the case and I am sure he deserves his punishment. I just think one should be what they are, not what they or someone else wants them to be.

That is a fricked up law. The cop shoots the burglar and the other burglar gets charged with murder? WTF?

If you're going to commit a burglary, a reasonable person should be aware that there is a chance someone might get killed. Whether that person is killed by the burglar, the police, or the victim protecting themselves, you still should realize there is a fairly decent chance someone is going to get hurt, possibly even killed. Don't want to be charged with felony murder? Don't commit a felony

I'm perfectly fine with that law.

But several in the group, including Washington, fired shots at Millbrook police officers who responded Feb. 23, 2015, to a call of a burglary in progress, according to officer body-camera footage. The officer that Washington ran toward pointing a .38 caliber revolver fired his police-issued sidearm four times, killing Washington

Oh wow, so Smith was charged with the murder of Washington, even though the police killed Washington. Of course if he hadnt been out robbing houses he wouldnt be there either...

... but it seems to me this would be a prime case to for juvenile court, not adult court, especially considering he didnt have a weapon or fire any shots.

I think the issue that some of us are happening is that a murder never occurred. The cop was justified in firing on his buddies. So it doesn’t really seem to make sense to charge him with murder.

Armed robbery? Obviously yes but murder makes no sense.

Man that's gotta suck. When that 25th year rolls around, it's gonna hurt knowing you could have gotten out. But now you have 40 MORE years

Felony Murder doctrine my friend. If someone dies during the commission of a felony, you're getting charged with the murder too.

Okay, he is a POS, but that is a bullshite law.

Cops kill someone, but you are held accountable for THEIR trigger finger.

I've got absolutely ZERO problem with this. If someone dies during the commission of a violent or grave felony, anyone committing the felony gets hit with a murder charge? Good.

Me, too. There are some dumb MFers in here that don't understand consequences.

I agree with this. The police shot the guy, not him.

It does not even appear that he had a weapon on him.

And he is convicted of felony murder as a 15 year old when he did not have a weapon and did not cause bodily harm to anyone?

That is a joke. Terrible law and sentence

Felony murder is on the books in every state in the union. The idea is that if you willing engage in a violent crime, then you are criminally responsible for any and all consequences of that action.

It's a good law.

Kids or adults as callous as these don't deserve to live amongst us. I'd be fine with life or death penalty even though cops pulled the trigger.

Ding ding.

Zero problems with this if it resulted to the death of a victim.

But if the actual perpetrator of the act didn’t commit murder, how could you be an asscessory to murder?

Which I would agree with if the kids had murdered someone.

Eta: I like the idea of being held accountable for ones actions, not the actions of others.

Judge Sibley Reynolds noted that Smith had shown no remorse for his actions during the entire trial process and took no opportunity to apologize.

Reynolds overheard Smith say, "I don’t have time for this" while waiting to be called and, and the judge confronted him about his comments.

“You got plenty of time for this,” Reynolds explained to Smith before handing down the sentence. “When I called the case earlier you said you ain’t got time for this, so I didn’t know if you had time for this now?”

Smith laughed and lowered his head, stating he didn’t know the judge heard him.
