Subodh Chandra, a Cleveland attorney who represents the Rice family in a federal civil rights lawsuit over the shooting, said he has resigned himself to the belief that the officers, both white, won't be indicted.

"This is apparently how long it takes to engineer denying justice to a family when the video of the incident clearly illustrates probable cause to charge the officer," Chandra said.

Unlike criminal trials, in which prosecutors must prove guilt beyond a reasonable doubt for a conviction, the burden of proof for an indictment is much lower. The grand jury would have to decide only that a crime might have been committed to indict the officers.

Activists used an obscure state law in June to petition a Cleveland judge to charge the officers. The judge ruled there was probable cause to charge Loehmann with murder and Garmback with reckless homicide based on the video, but he said the decision on criminal charges should be left to prosecutors.

Hard to believe the jury has been meeting since mid-October. They have to indict, right? This isn't Michael Brown where all the evidence pointed to a justified shooting. This is a 12-year old in a park who was shot dead within 2 seconds of coming in contact with the police. There's video showing the timeline and how it does not jive with anything the police are saying.

How can they not AT LEAST bring this to trial before a real jury?

Kid was asking for it. The cops perceived him to be a threat. If it's ok with the cops it's ok with me.

I really hope there's an Uncle Ben in the Rice family.

Cops should be innocent here.

12 year olds are perfectly capable of being gun pulling cop killing toos.

Second cop story in a few days where the cops protected and served the frick out of some idiots.

I'm loving cops this week.

I don't know.

Just sayin. You wanna get smoked? Do something stupid in front of a cop these days.

If I was a cop, I know I'd be quick on the draw if some idiot made a move that looked like a lethal threat.

It's all the fault of that slippery grass.

But, regardless, of innocence of guilt, this looks to be an easy indictment because a crime might have been committed.

I didn't watch the video or anything, just reading some of the comments above.

I'll tell you what I know...regardless of exactly what happened here, the idea that a dead child is something to be celebrated is ignorant beyond belief.

I'm not celebrating the death of a child.

Sorry if it came off that way.

Is this the same incident where the cop pulls up and automatically shoots the kid as soon as he gets out the car?

I remember thinking it looked bad the first time I saw it
