They are probably within their rights to fire him, but if he beats the charges I still say there is a lawsuit and settlement.

That's not how employment at will works. You can fire anyone at any time without reason. You can fire them because you don't like the shoes they have on one day.

I've fired for a lot less than shoes. And with me this guy would be gone as fast as Taco Bell did. I don't keep stupid employed. Not stupid douche. Stupid and trying maybe.
