In the state of Oregon it's the right wing to blame for this, libertarian judges taking the view that "until he is convicted by a jury he should remain free up until the very end".
It is also libertarian judges letting people do things like sleep in public parks.
Just saw an interesting piece on this on TV about a month ago. I think it was on Frontline (but not sure).
