We may have a motive now of why the thug shot the Trooper. He may have killed his roomate. You never know what you are going to deal with on a traffic stop.

I have tried not to post in an emotional manner in this thread out of respect for the fallen officer and his family but I hope they find the deepest,darkest,dankest, cell at angola that they can find and throw him in it for the rest of his miserable life.

Premeditation has nothing to do with it. Murder with aggravating circumstance* = 1st degree = d.p or life no parole. 2nd degree has no aggr circumstance and is life, no parole.
*killing an identified police officer; child; elderly person; while committing another felony; multiple murders.

Lying in wait is an aggravating circumstance in some states (like california - Robert Blake) but not in La., fortunately for Vince Marinello.

Would you like to read the first line to the class? However, I'll admit that I didn't know that LEO related killings are considered 1st degree in and of themselves, I thought that was immediately just plain-jane capital murder. Learn something new every day. It's unfortunate that it's in this type of circumstance though.

Being the operative phrase. And not all first degree murder is "premeditated" in Louisiana, in fact it's not even a requirement for such a charge. But please continue.

I was telling you thanks for clarifying...I'm not a lawyer (clearly), unless you count watching an inordinate amount of Law and Order. I was taking the term in relation to a national standard, not just Louisiana. Either way, right or wrong, I think this Daigle guy should fry, regardless of premeditation, first degree, malicious intent, etc.
