If that is what happened then it doesn't seem as though Hayes was fearing for his life so much that he approached the Mercedes with a gun already.
This is where it get's murky. The argument won't be that Hayes feared for his life the entire time. Just feared for his life the moment Smith turned to get the gun.

Smith is out/halfway out of his mercedes and Hayes is arguing with him a foot or two away. Smith says I have a gun, Hayes responds that he has one too. At which point smith turns to reach into his car. Hayes then shoots in order to not give Smith the opportunity to retrieve his weapon and shoot Hayes.
The act of possessing a gun does not preclude one from fearing for his life.

It's extremely possible that she was shot on the inside portion of her right leg, which would make total sense.

So the shooter walked toward Smiths car with his gun, Why?
Smith didn't have his handy, he might have been reaching for it. Smith was shot in the back more than once, wife was hit with a stray, Guys going to jail. Smith said to the guy, Get out of here, sounds like Smith didn't want any trouble. Shooter was bigger and weighted more than him.

Yeah they are gradually finding out it is too big of a case that will be scrutinized to frame it like they want.

Maybe he just had it on him. I haven't seen anything that paints the picture that hayes walked up gun in hand. Have you?

The NOPD doesn't necessarily have to let everyone know all of the information immediately.
That is a problem with our country now. Everyone feels that they are entitled to know every detail of every event immediately.
Don't get me wrong though, I have no faith in the NOPD nor the DA's office and would not be surprised to see them screw this up.
Do you have a link to that? Or is that some piece of info you are making up too?

What are the thoughts on the witness saying Hayes didn't draw his gun until Smith proclaimed "hey I have a gun"

This is bullshite IMO. Come on, he hauled arse and followed Smith after he was rear ended and proceeded to run into the back of him on purpose. He was being the aggressor and had a score to settle at that point.
Rear ends Smith, and Smith gets out and words are exchanged. Smith turns his back and towards his center console for possibly a gun because HE was the one fearing for his life. At that point Hayes comes up behind him firing shots into Smith and through him striking his wife.

Yes Hayes appears to qualify under the Louisiana Stand Your Ground Law. This law does not provide any provisions that the party shooting has to retreat either so he would qualify. The sad part is the NOPD knew about this gun on day 1 when the weapon was on the dashboard of the Mercedes. They didn't need a freaking warrant for a weapon that was open and notorious to the public view.

So your argument is that if you are faced with a situation in which you have a gun and the other guy is reaching towards a gun one foot away, you shouldn't fire until the guy picks it up?
