If the shooter was following Smith to get his plate number, why didn't he just get that and leave? Why did he plow into Smith so hard that he damaged the front of his Hummer, even with a grill guard on it? Lots of unanswered question with this. Does this make you think twice about carrying a gun in your car?

The argument will be Smith said he had a gun (which he did) and reached for it. This after Hayes was rear ended by Smith and he took off in a hit and run running through the red light. Smith was reckless and Hayes feared for his life when this guy announced then reached for a gun. Hayes was in imminent danger and had to shoot. There is the defense. This will be ugly drawn out court battle.

Why did Hayes approach Smith with a gun? How did he know he would need a gun?
He didn't know Smith had a gun when he got out of the car with one.

How many times do we have to go over that the witness said Smith was the first one to say he had a gun? THEN Hayes said frick that, I have one too.

Just playing devils advocate here: was he supposed to wait until smith turned around with the gun and had it in his face before he fired? That entire sequence undoubtedly happened extremely fast.

And that is the key.

For a bullet go through Smith and into the wife's right leg, Hayes had to be at the door of the Mercedes at close range.

If that is what happened then it doesn't seem as though Hayes was fearing for his life so much that he approached the Mercedes with a gun already.

Now if Hayes is at his H2 things are a little different as he may be able to say he was fearing for his life. But then how does the wife get hit?

But was smith reaching for his.

Two people saying to each other that they have guns is one thing. One of those people then reaching or drawing their weapon is different.

I mentioned that earlier. I don't understand how she was hit in the right leg. Maybe she unhooked her seatbelt and moved a position facing the driver's side. That's not even an assumption, though.

And, I haven't seen anyone knighting for Hayes, only people questioning what happened because there are obviously facts we don't know.

-smith hit n run hayes
-hayes was pissd n followed him
-they both had argument
- smith says he has a gun and goes back to vehicle
-then hayes feared for his life at that moment and reacted

The NOPD is so screwed up on this case it is hard to trust anything they do even when you try to give them the benefit of the doubt.

When the issue of Will Smith "potentially" drawing his gun from the car first came out by the first defense attorney assigned to Hayes the NOPD told the media "well keep in mind he's a defense lawyer" when they were directly asked about Will Smith being armed 3 days ago.

So now three days later the NOPD admits that Will Smith had a gun but said they couldn't locate the gun because they needed a search warrant to search the car. What total and utter bullshite. The NOPD should have released the information about 2nd Gun on Sunday night when the loaded gun was clearly visible on the dashboard of the Mercedes.

At this point I do not see how the DAs office will be able to indict Hayes on Murder or even Manslaughter charges. I think he will be charged with illegal discharge of a firearm in Orleans Parish and the unintentional bodily injury to Smith's wife from the fog of war where he just rattled off 6 shots in 2-3 seconds.
