can someone ELI5 why this matters if he did do a break check or not. Does this give Hayes the right to gun down a person? Does this create the possibility of getting murder 1 or 2?
I think the bigger issue here is what happened when they stopped and confronted each other. What was said and what was done especially by Smith. If unprovoked, Hayes shot at Smith then this thing is over.

that's great and all but none of this changes the scene of the other incident. witness claims hayes was freaking out saying we want to fight you and all this harassment. I've yet to hear anything how this legally changes anything.
You don't think the cops knew of any of this, or maybe its very irrelevant. Cops knew of this story from the get go from Hayes, none of it was relevant or justified any enough to warrant actions from hayes.

1.Smith's car rear ended Cardale's
2. Cardale pulled over like u normally would after a wreck
3. Smith hit and ran.
4. Cardale called 911 to report the hit and run
5. Cardale followed Smith

You have made yourself look like an arse multiple times in this thread.
Obviously there is enough evidence for a murder charge but there obviously much more to the story.
I am curious to know if all the shots fired were from one gun. Or if one of the shots came from Smith and that is what hit his wife.

Yea someone posted earlier that more than one gun may have been fired, but I haven't seen that confirmed anywhere.

Not quite Fred. Quibbling over the Hit and Run is childs play. Being mad about the hit and run only further proves the point of the original "road rage" scene that Hayes demonstrated after being hit.

i can admit this is one scenario that COULD be a game changer... but what could have cause smith to misfire at his wife... possibly being shot from behind?

Not necessarily. NOPD only responds quickly to shootings.
Car accidents, car jackings and home invasions/burglaries take forever to get a response.
They still could have had words as a result of the impact to Shooter's prized Hummer and Will could still be dead.

I didn't put it up as a fact yet as we don't know for sure that the witness is correct when he said Smith was the first to say he had a gun. Will have to see that one play out if it can be added to the "facts" for a self defense argument.

Yeah I have no idea but the way the defense attorney has approached this makes me believe that there is more information for him to think that it is justifiable.
This should not have ended in anyone's death but people will speculate and choose a side.
I would prefer to wait and see before making a decision.
