I don't know if he'll ultimately be exonerated, but the shooter's actions after don't match up with someone who just murdered someone in cold blood and knows he's culpable.

That's what keeps eating at me.

That is an odd intersection. Still seems like he stops sooooo short. Especially when he braked exactly to white line at the light before.

I don't think it's too crazy to think he may have actually feared for his life. The ultimate question is, why was Smith shot in the back?

Biggest factor IMO will be if they find a gun in Smith's car. I feel like it would already been reported if they did, but I have zero clue on timeframes behind these types of cases.

Not sure what that video has to do with being a murderer. The defense will probably spend 5 minutes on that. The only events that matter is what transpired after Hayes ran into Smith, ending with the police showing up. The actions in that video will not exonerate him and won't hold in water in the court of law. What it does is it gives us a scenario to work with and something to talk about.

it looks like he stopped around 100-130 feet before the light. but again, if the cops show up smith is getting the ticket and is at fault for following too close failure to yield type shite.

Right. Say Smith claimed he had one while they were talking shite and then ran to his car. Does Hayes have to confirm there is a gun before shooting?

Maybe there was a car in front of him or he thought someone was coming out into the road. That's a busy street with plenty of drunk people

I don't know how it works in other places, but up here in Live Free or Die country, if another driver so much as looks at you funny -much less honks their horn, flips a bird, etc.- one usually just pulls out the old heater and pumps them full of lead. I mean, drivers being dicks deserve to die and it's even worth your own death trying to set them straight, right?

the lawyer said there was a 2nd gun.

i know, i know, he's supposed to defend him.

but he was dead on about Smith hitting and running before there was any video of that.

Most people well versed in the law would say yes

Hayes' lawyer is likely facing an uphill battle with the wounds in Smith's back. If he (smith) indeed did have a gun and was shot in the chest, he (Hayes lawyer) would have a strong defense imo
