Violent crime has the 85% rule in La.
There was a good bit of intent in what he did.
10 is appropriate for the fool who shoots his gun in the air on NYE and kills someone..he made a "mistake".
To me, guys like this are big dangers to society. They get pissed and start shooting...that's dangerous.

Two big issues here:
The kid who died lived relatively across from Fontenot. so just creeping by so they could drop him off to sneak in doesnt make much sense when you consider fontenot was in bed with his gf, heard a noise, grabbed his gun and ran outside. THEN they passed him and he fired. doesn't add up
Also fontenot said he fired at the tire but the first shot shattered the back glass and hit Austin in the head. So fontenot lied

Or he's a bad shot who didn't anticipate the amount of kick on his handgun correctly because he wasn't in the controlled situation he practiced in and was excited/flustered/out of his element.
He's definitely an idiot. But he's not definitely lying (don't read that as "definitely not lying"), even though he very well could be.

Yeah if the DA feels like he doesn't have a rock soliid case, and even if he does they will usually add lesser charges in order to get a conviction. That guy isn't going to walk out of that court room without handcuffs on.

this is not a correct statement, it was brought out in trial that it was much further

Except there were 3 cars in the drive way and they only dusted prints on one....
So many holes in this case....it sucks for everyone....
But I believe Seth got a raw deal...media went to town with this...
to bad it was never explained why the 2 kids never called 911 - they called their friends and their manma's and then drove to the hospital....why not call 911 ?
Who gave them the beer or bought it for them ?
Why did the police never question the girlfriend (Seth)

I believe this was a horrible accident, and I feel for both familys....
Do I think he needs to do 20 years - nope.
I believe he was first screwed when the Grand Jury refused to let him testify on his behalf. Hope he can appeal
And why did the other two kids let Austin bleed out in the back seat....seems like they should have called 911 (not their mama's and friends and then DRIVE to the hospital) - where is the anger and out rage over that ????

Sentencing was scheduled for 10:30 this morning, should be finding out what the verdict is soon
