The kids never attempted to break in his truck. There were other unknown people who did break in his trucks multiple times before the children. Wan't to know why? Seth was selling adderall, and people would try to break in to steal it. Seth texted one of his friends in December 2012, "I swear I am going to kill someone the next time they try this" I am pretty biased to the kids in this situation, but Seth should not just walk a free man. I also do not believe he should, or will get first degree murder. He made just about the dumbest mistake one could make, but he is not a threat to society. That being said he did kill a 15 year old boy, and injured two others. Bad situation for everyone involved.

On the other hand, if you shoot 3 otherwise good and normal kids driving down your street because you stupidly thought they were breaking into your truck, then you go to prison for along time.

That is why the jury will decide first if they thought they were the actual robbers. If so sympathy will go with Seth, if not it will go with the kids who were mistaken for robbers. The verdict will reflect this.

you can't kill someone for a property crime.

Not so fast my friend. You can in a lot of states now. That is the reason behind "Stand Your Ground" laws.

You keep stating that, but propery doesn't come into play with stand your ground. It simply means that you don't have a "duty to retreat" when faced with a threat.

If they enforced this crime, every student at UL's campus would be in jail. This is just an attempt to trash his character. He's no drug dealer. Bad situation though, can't say that his life was in danger regardless of what the kids were doing however in Louisiana you have the right to protect your home and your truck is an extension of your home. Charges will depend on if the jury believes they were robbing his truck I think.

I'm not assuming anything. Its the courts job to decide. Really a shitty situation all the way around

As it happens, I apparently understood it even better than I would have guessed. Even when charged with 1st degree murder, "every jury is instructed on the crimes of second-degree murder and manslaughter and permitted to consider those verdicts even if no evidence supports the lesser verdict; and if a lesser verdict is returned it is treated as a acquittal of all greater charges."

So, in short, the perp was charged in this situation with the lesser and included offenses per Louisiana law, which makes great sense.

Exactly. Shooting at people fleeing in a vehicle, even if you had them on video stealing everything in your front yard, has zero to do with "stand your ground" laws.

The boys said they were trying to sneak the deceased back home.

But driving slow and quietly by, as they claimed to be doing, can't be enough to wake up Seth, give him time to get his gun, and then go outside and confront them. Seems like something more than that would be necessary to get his attention at 1:30 am. Unless Seth was lying in wait for them, which it doesn't look like he was.

To everyone who thinks he deserves the harshest penalties possible, I hope hoodlums repeatedly break into your vehicles/dwellings and flee...and all you can do is sit there and watch them and twiddle your thumbs.
