This seems like a pretty decent deal this lady got. 1 year of house arrest. I am curious how she plans to come up with $25,000 a month for restitution though. That is OT Baller money. She can't be earning that much so it must be family money. If it is, why not just pay it all now?

quote:

The former finance director for Franco's Athletic Club in Mandeville, one of two people accused of embezzling nearly $2 million from the business, has pleaded guilty to theft and identity theft charges.

Emily L. Davis, 43, of Ponchatoula entered the plea Wednesday (Sept. 26) before state Judge Richard Swartz Jr., who ordered Davis to serve one year under house arrest and pay $1 million in restitution to club owners Ron and Sandy Franco, court documents show. Court records show $100,000 was paid Wednesday; under the plea agreement Davis must pay another $25,000 in restitution each month for 36 months.

Davis pleaded guilty to three counts of theft over $25,000, one count of theft between $5,000 and $25,000, and two counts of identity theft, records show. Swartz sentenced her to 10 years in prison on each of the counts, but suspended nine years of each sentence and ordered her to serve one year under house arrest on each count. The sentences are to run at the same time. Davis must perform 320 hours of community service and serve three years of supervised probation.

Hopefully she went to the money board and consulted them and should easily be able to make them payments with the advice she received

Maybe from the $2m that she stole. Looks like she made a cool $1m profit minus attorney fees off of this.

The sentences for white collar crime are the real white privilege.

Wait, I can steal $2M, then just have to spend a year on staycation, playing PS4 and getting Waitr delivered and I walk with $1M?

I've made bad fricking career choices.

People don't steal $2 million and just put it into savings. She spent it and there is no way she has that kind of money to pay back. People are ordered to pay large amounts all the time and they don't have it.

I bet she spent a lot of that on big purchases, house, cars, boats, etc. They probably seized around a million worth and that is why she owes the other million in cash. If she had it sitting in a bank it would have been seized and handed over. So she doesn't have this money.

Why you gotta shite all over my lazy theft fantasy, man?

I'm guessing that accomplice #2 wasn't working for free.

And if she doesn't have it, she goes to jail anyway?

What kind of cash flow goes through that place that she was able to skim $2 million without anybody noticing right away?

Judges usually don't like it when you fail to follow their orders. I don't know if failure to pay according to the judgment gives the judge a reason to toss you into jail or if it's just a civil court thing at that point.

Her wages will be garnished in perpetuity and if she ever inherits property, there will be a judgment against it.

I’d say keeping half is how she’ll pay for it.
