I'm not sure how it is in other parishes but in St. Tammany a student can get in trouble for something they post outside of school. I've even heard of people who had videos of fights between other kids that occurred outside of school and they were punished for having it on their phone.

Are they? She wasn't suspended or expelled. She was kicked off the Cheerleading Team right? I thought they could boot anyone off of a team for pretty much anything.

She should be in trouble for not fact checking her numbers.

Children do not have freedom of speech in schools. You give up that right as part if the social contract of being schooled by the government.
Children can pray in school. They all have a "moment of silence." A school cannot force religion in a child. You would be the first one crying if your child was forced to pray to Vishnu.

But it does protect students from any action of the school that impairs, prevents, or "chills" the speech so long as that speech does not interrupt the normal flow of school or threaten and harass another.
If the school removed the girl from the team simply because of the tweet, then she probably has a viable case against the school board. It would be tough to argue that the tweet amounts to harassment or a threat.
