Ronald Gasser can't be retried for murder in Joe McKnight killing, state Supreme Court say

Gasser, convicted by a 10-2 jury vote on the lesser charge of manslaughter, had challenged a decision by the Jefferson Parish District Attorney's Office to retry him on the original second-degree murder charge after his conviction was overturned in 2020.
Gasser was granted a new trial after the U.S. Supreme Court issued a ruling in 2020 making split verdicts illegal.
In an opinion penned by Justice Jay McCallum, the state Supreme Court ruled that Gasser's manslaughter conviction operated as an implied acquittal of the more severe charge of second-degree murder.

Wasn’t he 55 when he was originally arrested back in 2017? And he was sentenced to 40 years, you think he’ll die in prison?

Good call by the court on not making him face jeopardy on the murder charge again.
His attorneys convinced two people last time he wasn't guilty of manslaughter. This time around they only need to convince one to spring him. It wouldn't surprise me at all if the DA decides to accept a plea for a lesser charge for far less time, and maybe even time served, to protect the felony conviction.

If he doesn't I doubt he will be a threat to anyone at 95.

I recall it started in New Orleans. Shooting was about 100’ over the parish line on JP side at corner of Berhman and Whitney.

His attorneys would have actually convinced all 12 he wasn't guilty of murder due to lesser included charges.
For another example, a 10-2 conviction on 2nd degree murder doesn't mean those 2 didn't think the guy killed the person, they may have thought he was guilty of manslaughter, and so on.
